The Department of Justice is asking the ninth circuit court of appeals to rule before the end of day Wednesday on a federal judge’s rejection of its request for a stay of her worldwide injunction on the “don’t ask, don’t tell” policy. Federal Judge Virginia Phillips rejected the Justice Department's motion for a stay Tuesday afternoon.
The Department of Justice will request a stay Thursday of a federal judge's injunction barring enforcement of "don't ask, don't tell," sources have confirmed to The Advocate. Sources said Justice Department attorneys are expected to file the request to U.S. district judge Virginia A. Phillips in Riverside, Calif., this afternoon. But Richard Socarides, a New York lawyer and former LGBT adviser to President Bill Clinton, said getting the stay on the suspension of discharges was not guaranteed and that if the court of appeals failed to grant it, the Justice Department would have to appeal to the U.S. Supreme Court.

The Department of Justice announced Wednesday that it will not defend section three of the 15-year-old Defense of Marriage Act in federal court after a directive from President Barack Obama. Two lawsuits, Pedersen v. OPM and Windsor v. United States, challenge section three of the law passed in 1996. U.S. attorney general Eric Holder said in a statement that the decision to stop defending DOMA in these and other cases hinged on Obama's recent decision that the law is unconstitutional.
